Terms and Conditions

1. General

1.1 These General Terms and Conditions (GTC) apply to all services and treatments provided by the surgical private practice Prim. Dr. Andrzej Sebastian Gasz (hereinafter referred to as "InterChirurgie").

1.2 Divergent conditions of the patient shall not be recognized unless the Practice expressly agrees to their validity in writing.

2. Services and Fees

2.1 The Practice offers medical services in the field of surgery. The scope of services is determined by the individual agreement between the Practice and the patient.

2.2 Remuneration for services is based on the currently valid fee schedule of the Practice. This fee schedule is available for inspection at the Practice and will be provided to the patient upon request.

2.3 Billing is carried out immediately after treatment. The patient will receive a detailed invoice, which must be paid within 14 days of receipt.

3. Cost Reimbursement

3.1 The patient has the option to submit the invoice to their statutory or private health insurance for reimbursement. The amount reimbursed depends on the conditions of the respective health insurance provider.

3.2 The Practice does not guarantee full or partial reimbursement of costs by the patient’s health insurance.

4. Appointments and Cancellations

4.1 Appointments are scheduled by arrangement. The patient is obligated to keep agreed appointments.

4.2 If the patient cannot attend an appointment, they must cancel at least 24 hours in advance. In case of late cancellations or no-shows, the Practice may charge a cancellation fee.

5. Liability

5.1 The Practice’s liability for damages caused by slight negligence is excluded, unless it concerns the breach of essential contractual obligations.

5.2 Liability for gross negligence and intent remains unaffected. The same applies to liability for damages resulting from injury to life, body, or health.

6. Data Protection

6.1 The Practice collects, stores, and processes the patient’s personal data solely for the purpose of fulfilling contractual obligations and in accordance with applicable data protection laws.

6.2 Further information on data protection is available in the Practice’s privacy policy, which can be viewed on the Practice’s website and at the Practice premises.

7. Final Provisions

7.1 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that most closely reflects the economic purpose of the invalid provision.

7.2 Amendments and additions to these GTC require written form.

7.3 The law of the Republic of Austria applies. The court of jurisdiction for all disputes arising from the contractual relationship is Vienna.
